Dear Professor/Author:

We are pleased that you have chosen to publish your article tentatively entitled (insert title) in the Journal of International Law and Politics. We ask that you, as author of the Article, enter into the following agreement by signing below and returning a copy of this letter to the undersigned:

1. You hereby grant to the Journal of International Law and Politics exclusive first publication rights in the Article and other such rights as are enumerated below. The Article is tentatively scheduled to be published in Volume ___ of the Journal of International Law and Politics, but such schedule may be changed by the Journal of International Law and Politics at its sole discretion. You will retain the copyright to the Article.

2. You hereby grant to the Journal of International Law and Politics, exclusively for a period beginning when this agreement is signed and ending one (1) year after the date of publication, and nonexclusively thereafter, the rights to print, reproduce, distribute, and sell the Article, or any portion thereof, in all manners customary to law review administration including, but not limited to: publication as part of the Issue, publication as individual reprints, reproduction as part of bound volumes including the Issue, and reproduction in a collection published by the Journal of International Law and Politics.

3. You hereby grant to the Journal of International Law and Politics, exclusively for a period beginning when this agreement is signed and ending one (1) year after the date of publication, and nonexclusively thereafter, the right to authorize others to publish portions of or the entire Article, including translations into any other language, in journals, magazines, newspapers, casebooks, treatises, and anthologies. After the first year, you may also grant permission to third parties to use and publish the article, provided that you require any such user or publisher to cite to the initial publication in the New York University School of Law Journal of International Law and Politics. The Journal of International Law and Politics reserves the right to charge an administrative fee; the Journal of International Law and Politics shall discuss with you an appropriate allocation of any such additional amount.

4. You hereby grant to the Journal of International Law and Politics the exclusive right to license the Article for inclusion in electronic database services, including but not limited to Lexis, Westlaw, and HeinOnline.

5. You hereby reserve the right to distribute draft copies of the Article prior to publication in any manner customary to academic communications, including electronic distribution on the Social Sciences Research Network (SSRN), provided that the reproduction includes notice that it is a draft and that publication will be forthcoming in the Journal of International Law and Politics, and further provided that the posted draft is replaced with a link to the published version and/or an abstract upon publication.

6. You hereby grant teachers, instructors, lecturers, and professors at educational institutions the right to photocopy portions of or the entire Article for educational use, provided that: (a) the copies are distributed or made available to students at or below cost; (b) the initial publication of the Article in the Journal of International Law and Politics is cited on each copy; and (c) proper notice of copyright ownership is affixed to each copy.

7. You hereby represent and warrant that the Article constitutes your own original work, that no part of the Article has been published before, and that the Article does not plagiarize or infringe the copyright, trademark, patent, or other rights of any person or entity, nor does it defame, invade the privacy of, or otherwise violate the rights of any person or entity. You further represent and warrant that the Article has been withdrawn from consideration for first publication in any other journals, edited volumes, or conference proceedings.

8. You hereby indemnify and hold harmless New York University, the School of Law, and their respective employees, trustees, and agents from any loss, expense (including reasonable attorney's fees), claim, or damages arising from a breach of any of the representations, warranties, or agreements made by you in this agreement.

9. You hereby agree to comply with draft deadlines and to cooperate fully with the Journal of International Law and Politics Editorial Board throughout the publication process. This includes but is not limited to cooperating with the Editorial Board when it seeks to make changes necessary to bring the Article into compliance with the spelling, stylistic, and structural conventions of American student-run law journals and the Journal of International Law and Politics’ own established standards. The Journal of International Law and Politics reserves the right, should the author change more than 10% of the piece from its acceptable version without consulting the Journal of International Law and Politics, to revert to the originally accepted version, amend the publication date, or revoke publication. The Journal of International Law and Politics further agrees to publish your Article subject to the understanding that it will not be published by the Journal of International Law and Politics unless, in its final form, it is reasonably acceptable both to you and to the Journal of International Law and Politics.

10. This agreement shall be governed by the laws of the State of New York and the federal laws of the United States of America. The parties agree to submit any dispute arising hereunder to the federal or state courts located in New York County.

Please indicate your agreement with the above by countersigning one copy of this letter and returning it to me at the above address or fax number at your earliest convenience.
