Publication Agreement

And Nonexclusive License

1. In exchange for Constitutional Commentary’s agreement to publish [title of piece], which in this agreement is referred to as “the work,” I assign to Constitutional Commentary the nonexclusive right to

a. Reproduce and distribute the work in Constitutional Commentary before it is reproduced or distributed in any other publication, except that I may post a draft of the work on SSRN or other database or website.

b. Edit the work to fit Constitutional Commentary’s requirements, subject to my agreement on the final version.

c. Authorize others to reproduce and distribute the work.

d. Authorize others to include the article in databases such as LEXIS or Westlaw.

2. If I license others to reproduce, distribute, or make other use of the work, I will require my licensees to acknowledge first publication of the work in Constitutional Commentary

3. I represent and warrant that I am the author of the work.
