AMERICAN JUDICATURE SOCIETY � Publisher of Judicature 2700 University Avenue Des Moines, IA 50311 (515) 271-2281 ASSIGNMENT OF COPYRIGHTS AND OTHER RIGHTS The American Judicature Society (‘‘the Society’’) publishes Judicature which has accepted for publication in a forthcoming issue an article/review/essay by the author(s) whose signatures appear below and is entitled:

In consideration for publication of this article/review/essay in Judicature:

1. The author(s) transfer, grant and assign exclusively to the Society, as a Work Made For Hire, any and all publication, republication, and all other rights of whatsoever kind or nature, including all rights protected by the copyright laws of the United States and all other countries, in all languages in and to the above article/review/essay, including all subsidiary rights and the right to register the copyrights to the article/review/essay in the name of the Society at the United States Copyright Office. The author(s) specifically understand and agree that the Society may grant the right to microfilm or photocopy the article/review/essay and distribute those microfilms or copies in response to occasional requests; and that the Society may grant West Publishing Company the right to distribute the article/review/essay on its WESTLAW Information Distribution System.

2. The Society grants back to the author(s) the right to republish the article/review/essay in any book in which he/she or they are the author(s) or editor(s), without fee, provided proper credit is given in the book to the original publication of the article/review/essay by the Society and Judicature.

3. The author(s) warrant that the above article/review/essay has not been published previously in and is not scheduled to be published in any other publication; that it contains no matter which is unlawful in content or violative of any rights, including copyrights, of any third party; and that the author(s) have full power to make these warranties and grant these rights. Should any litigation arise on account of the article/ review/essay, the author(s) agree to reimburse the Society, its officers, its staff, or any other party involved in the publication process on behalf of the Society, for the cost of the litigation, the reasonable attorneys fees incurred by the Society or the other party, and any other payments that may be made as a result of the litigation.

4. The author(s) will be given the opportunity to read and correct copy either before or after the manuscript is set in galley. In the event of multiple authors, this opportunity will be given to only one author. If the authors fail to return a corrected copy of the article/review/essay or of the galley copy by the date set by the Editor of Judicature, production and publication may proceed without the approval of the author(s). The Editor of Judicature may, without consultation, make grammatical, spelling, punctuation and other minor stylistic changes at any point in the production process.

5. In the event that the Society grants any request for permission to reprint or translate all or any portion of the above article/review/essay for publication in a reader or anthology, the Society will inform the author(s) of such reprint use by mail addressed to the author(s) at the address(es) listed below. In the event that these address(es) are no longer current at that time, the Society will make a reasonable attempt to locate the author(s). The Society will pay one-half of any fees received for such reprint use to the author, or in equal shares to all authors in the case of multiple authors. The author(s) will be given the opportunity to donate all or some portion of the fee to the Society, but the author(s) are under no obligation to do so.

6. The author(s) understand that the Society must report to the U.S. Internal Revenue Service any monies actually paid to the author(s) by the Society, and that such reports must include the Social Security Number of each such author.
