     We are very pleased that you have accepted our offer to publish your article entitled “A Comparative View of Copyright as Cultural Property in Japan and the United States” in the Temple International & Comparative Law Journal's Fall 2006 issue.

MEMORANDUM OF UNDERSTANDING

1. Execution of this Memorandum of Understanding grants to the Temple International & Comparative Law Journal the right to do or authorize the publication, reproduction and distribution of the article or revisions of the article in any form, including hard copy, electronic media, computerized retrieval systems and similar forms, and to transfer such rights, except as may be limited by the last sentence of this paragraph. This grant covers manuscripts, photographs, drawings, charts, designs, computer disks, and any other material submitted by the contributor. The contributor retains all other rights including but not limited to the rights to create derivative works of the article and to distribute them, the right to excerpt or cite the article, and the rights to display and/or perform the article and any derivative works publicly.

2. By signing this document, the contributor hereby understands that their article may be republished on Westlaw and/or Lexis-Nexis. In addition, the contributor in particular, but not exclusively, agrees to: (1) allow the article to be copied for classroom use, provided the procedure as set forth in each Journal issue is followed by the copier of the article, and (2) assign to the Temple International & Comparative Law Journal any rights in the article that permit it to be placed upon any electronic data system such as Westlaw or Lexis-Nexis or used with any such system.

3. The Temple International & Comparative Law Journal assumes no responsibility for the loss of, or damage to, any material. The act of mailing material shall constitute an express warranty by the contributor that neither the items mailed nor their contents are in any way an infringement on the rights of others.

4. Required changes will be made with the approval of the contributor, and pursuant to the terms of the letter of agreement. Changes may include change in publication date if the Journal discovers that substantial work on the article is necessary.

5. Upon the contributor's receipt of a request to reproduce the article in whole or in part, if the contributor decides to allow its reproduction, the contributor must: (1) expressly include in the reproduced text that it was first published in the Temple International & Comparative Law Journal, and (2) notify the Journal in writing within a reasonable time of the contributor's decision to have the article reproduced. If the Journal receives a request for purposes other than educational use as referenced in paragraph 1, the Journal will notify the contributor in writing and in a timely manner of the request using the most current address of the contributor as it appears in the records of the Journal.

6. The contributor, in accordance with this Memorandum of Understanding, hereby grants to the Temple International & Comparative Law Journal a non-exclusive license to republish the article listed below solely for non-profit educational uses. The Contributor also grants to the Journal a non-exclusive license to grant others permission to copy the article identified below solely for non-profit educational use, provided that the procedure as set forth in each Journal issue is followed by the person or persons copying the article.

7. The contributor retains all rights not limited by this Memorandum of Understanding.
